SIMULATION RACING LIABILITY WAIVER AND RELEASE FORM

This waiver releases Simulation Zone Inc., its officers, employees, contractors, agents, and affiliates (collectively, "Released Parties") from any and all liability relating to injuries or property damage that may occur during participation in simulation racing activities. By signing this waiver, I acknowledge the risks involved with simulation racing, which include but are not limited to dizziness, nausea, motion sickness, emotional distress, bodily injury, or damage to personal property.

I hereby agree to the following:

  • Acknowledgement of Risk: I fully understand and accept the inherent risks associated with simulation racing activities, including equipment malfunctions and physical responses to simulation experiences.
  • Release and Waiver: I voluntarily waive any right to legal action against Simulation Zone Inc. and the Released Parties for any injury, illness, damages, or loss that may result from my participation in simulation racing activities.
  • Assumption of Risk: I expressly assume all risks associated with participation, acknowledging that these activities may involve physical and emotional stress.
  • Indemnification: I agree to indemnify and hold harmless Simulation Zone Inc. and the Released Parties from any claims, actions, damages, costs, or expenses, including attorney’s fees, arising out of or related to my participation in simulation racing.
  • Health Declaration: I declare that I am physically fit and have no medical conditions that would prevent my safe participation in simulation racing activities. Should my health status change, I will cease participation immediately.
  • Rules and Instructions: I agree to adhere to all rules, regulations, and instructions provided by Simulation Zone Inc. and its representatives. Failure to comply may result in termination of participation without refund.
  • Minor Participation: If signing on behalf of a minor, I affirm that I am the legal guardian and assume full responsibility for the minor’s participation and compliance with this waiver.
  • Photography and Video Release: I grant Simulation Zone Inc. the right to take photographs and videos during simulation racing activities. I authorize Simulation Zone Inc. to use such photos and videos for promotional, advertising, or educational purposes without further permission or compensation.
  • Governing Law and Venue: This Waiver shall be governed by and interpreted under the laws of the State of Illinois, without regard to conflict of law provisions. I agree that any legal action arising out of or in connection with this Waiver shall be brought exclusively in the state or federal courts located in Lake County, Illinois, and I consent to the jurisdiction of such courts.
